This course will focus on the major procedural and substantive issues that arise in the context of complex civil litigation. For the purpose of this course, litigation is considered complex because of the nature or quantity of information involved. The course reviews and expands on the topics covered in the first-year Civil Procedure course, with a focus on MDL and class action litigation. Specifically, the course will consider the preclusion doctrines, joinder devices, the management of complex discovery, and advocacy techniques. The course format is a combination of short lecture, class discussion, and simulations. Several Law instructors at Elon University possess undergraduate degrees in literary studies and remain interested in developing further courses that use literature, including a more traditional 'Law and Literature' course.
